Important Fatwa Regarding Fighting Americans Outside Iraq

((Written by the noble Shaykh, Naasir al-Fahd on the 10th of April, 2003. – abu muQatil))

Question:

Assalamu 'alaykum wa rahmatullahi wa barakatuh, to proceed:
I have read the second part of your book, at-Tibyaan fi Kufri man a'aan al-Amreekaan, the title of which is: "The Crusade Campaign in its Second Phase: War on Iraq", and I benefited much from what you mentioned from rulings regarding this campaign, like the ruling on supporting America, and the ruling on supporting the Iraqi government, and the ruling on supporting the Muslim nation in Iraq.

Except, there was a matter that was not mentioned despite its importance, and it is:

What is the ruling upon doing Jihaad against the Americans, and fighting them outside Iraq, like attacking their interests and bases and hiting them in different places of the world, and this is regarded from Jihaad? And do they have a covenant with us, in those countries were they do not [openly] fight us in? And is the saying of the Messenger sallallahu 'alayhi wa salam, 'Whoever kills a person under covenant will never smell the fragnance of paradise"' And if we say that they are not under covenant, but fighting them would result in greater disadvantage, [would it then be] legislated to fight them?

Jazakumullah khayr.

Answer:

Wa 'alaykum assalam wa rahmatullahi wa barakatuh, to proceed:

Undoubtedly then, that the greatest of enemies of Islaam, and the Muslims in this era are those Americans, and if we wished to follow-up on their crimes against Islaam and its people in the recent times we would have spent ages on it; for they have killed nations of Muslims, in Iraq and Afghanistan alone almost two million, and have embargoed nations, and expelled nations, and brainwashed nations, and plundered the riches of the Muslims, and occupied much of their land, and placed tawagheet on the people, and they did in this ummah what no one did in ancient or recent history.

And today, we see them launching the thousands of rockets and tonnes of bombs on the heads of the Muslims everywhere, and they do not differentiate between a child, an old man, and a woman!

And why should they differentiate?!

For the Muslims, in thier eyes, are nothing but a collection of insects, whose extermination from this world is necessary.

So doing Jihaad against those cursed ones, and awaiting for them, and fighting them wherever they may be is: from the most important of obligations, and the greatest of things that can bring you close [to Allah subhanahu wa ta'ala]; for they have corrupted the lands, and killed many of the servants, and fought the Muslims everywhere, so there is no doubt that they are the 'leaders of disbelef' in this era, without dispute, and Allah, the Most High has said, 'So fight the leaders of kufr, verily they have no protection', and if I had ten spears [only], I would have thrown it all at them, and no one else except them, and I swear by Allah: If my chance to do a martyrdom operation against them becomes easy, I will do it without any hesitance whatsoever...

And if Allah raises from amongst this ummah of one billion a thousand - only - from the 'martyrdomers' who quake their bases and interests everywhere, they would have defeated them and returned them humilated losers...

So what a shame:

Do those pharoah's enslave the Muslims, and taste them the severest of punishments everywhere, and then find no resistance, rather they find protection from the tawagheet and their slaves?

And know, my dear brother, that the doubt of the one who prohibits fighting them and killing them in other than the lands in which they fight in is one of two:

The first: The doubt of the covenant:

So they say: They have a covenant with us, and whoever kills a covenant-holder does not smell the smell of paradise as is clear in the hadeeth.

The second: The doubt of the advantages and disadvantages:

So they say: Fighting them causes tribulation upon this ummah that it cannot handle.

So we say in reply:

As for the covenant, then no wallah, there is no covenant between us and them, nay, they are harbiyoon wherever they reside and live, even if they became attached to the coverings of the Ka'bah, for the covenants that the governments did with those crusaders is not recognised in the sharee'ah, rather it is based upon the charters of the false-dietic United Nations, and was signed by individuals who have no conciousness of Allah in their actions, and nothing is more important to those individuals more than preserving their thrones and status, even if the covenant was recognised, they would be considered as having broken that covenant in the tens, nay hundreds even; like their declaring that this is a crusade and fighting us due to our religion, to expelling the Muslims from their lands, to supporting those who expelled them, to violating many of the treaties, to involving themselves [in corrupting] the Islaamic rulings, to supporing the enemies of Islaam everywhere, to following up and spying on the Mujahideen on earth, and killing them, and imprisoning them, to pludering the treasures of the Muslims, and other than this from the matters of which a tenth would be enough to invalidate their covenant had it been shar'ee.
If the covenant between the Messenger, sallallahu 'alayhi wa salam and Quraysh was nullified due to Qurayh's support for Bakr over Khazaa'ah secretly, and for once only, so what of the actions of America which cannot be counted or numbered in this day and age...

Furthermore, it is not from the shar'ee covenants to allow the Crusaders and give them protection so that they may hit the Muslims however they want...And praise be to Allah, I have detailed the proofs and statements to establish that there is no covenant between us and those crusaders, and that between us and them is nothing except the sword, aswell as refuting many of the doubts casted in this matter in the book Nashr al-Bunood and I will release it soon insha'Allahu ta'ala.

As for the issue of advantages and disadvantages, then it is correct; for the matter if its disadvantages is greater than its advantage then it does not become permissable at that moment, except I notify you of two matters:

First: The advantages and disadvantages here are the shar'ee advantages and disadvantages, not the ones imagined [by some people].

Second: The people who sould look at the benefits towards the Jihaad of such actions and their harms are the Mujahideen, not the sitting ones who don't even know how to use a gun!
This is what I have to say in this short reply, and I have lengthened the talk about these matters in two books, that I will release soon insha'Allah - if Allah protects me from his enemies -:
One of them is, Nashr al-Bunood, mentioned above.

The second is the third part of at-Tibyaan fi Kufri man a'aan al-Amreekaan.
I ask Allah subhanah, to grant victory to Islaam and its people, and to destroy America and its allies, and to cure our hearts from them, and to remove their envy towards us, and peace and blessings be upon our Messenger Muhammed.

A Commanders Message To His Son

An advice to you O Saleh, from the land of War, Chechnya. The Islamic history has not recorded in its pages other than the deeds of those who were truthful to Allah; they implemented what they spoke, and advanced to the front line. Believe me, the Dirham (money) has occupied the worshipers, worshiping this world and worshiping the west, with work, and salary and whatsoever is with Allah is better. So the generations after generations have passed into a dead life of routine that is not far from the life of an animal, they rise in the morning to breakfast then to work, then lunch then home then dinner then sleep, the life has no goal. Believe me O Saleh, with all their might as humans, their aim in life, is to gain wealth and flourish and the troubles will never stop, ever, trouble with work, with the wife, with the children, with accommodation, and whenever one trouble is solved, another appears, they solve 10, and 20 appear, life ends and the trouble never ends.

And the Islamic nation today has all types in its communities, the scholars, the students, the tradesmen, engineers, thieves, and little are the soldiers of tawheed and jihaad. Now is It the time for Jihaad, the nation of Kufr is cautious, and needs only a final dagger's stabbing to finish it off, and Allah would have bestowed his grace upon the Islamic nation in this age, and I do not say the time of the Prophet (sallallaahu 'alayhe wa sallam) and his companions and those who followed them, so how can the poorest nation of the world, demolish the soviet's and smallest nation demolish the heart of Russia, from within Russia, if it weren’t for me living with these people, I would not believe it. Believe me O Saleh, the way of death can be chosen in a way (by trying to attain shahaadah going for jihaad), but its full knowledge is with Allah, where and when, go for death and life will come to you, have confidence in Allah, and trust Allah, for today we (people) believe in Allah, but we have doubts that Allah will give us victory, we are always suspicious, the airplanes and tanks of the enemies of Allah have installed fear in us from the gulf war
The Gulf war dissolved the faith of winning in the Muslims after regaining their faith from the victory of Afghanistan against the soviets, the military powers from east to west were disgraced against the power of those who believe in Allah, so the west came to the lands of Islam, the Arabian gulf acting a play to scare the Ummah of Muhammad, Saddam did not die or his soldiers, and the west became a beast, scaring the Muslims, and milking the Muslims wealth and the resources became a debt for a war of 18 years, and it continues.

Saleh, you will die alone, and will dwell alone, and remain alone, and the way is a long path, and the food is little, so increase your god fearing and Jihaad in the path of Allah, it is glory in this life and the hereafter, my dear you are now little, but insha'allah we have opened the way for you and your likes, and prepare and teach you that which your grandparents failed to teach us, so your generation holds the hope for the nation, and we age our faith will be in Allah, then in you.And sorry to say my dear one, the youth of today have become slaves to the devil, the T.V, the Dish, Soccer, and cars, fear dying in a useless way, and ask Allah for a good ending, martyrdom gathers you with the pure prophet peace and blessings be upon him and his companions, the martyrs are with the prophets and righteous.

My dearest thing to me praise Allah that you came in the land of jihaad, the tribe of your mothers people was destroyed, yet they fought for their religion and honour till the end, half went with your father to fight and the other half in prison and in graves, martyrs insha'allah. They were those who first claimed shari’ah in Daghistan, I will never forget when the enemy surrounded them from the four sides, and their towns were demolished so we joined the soldiers of tawheed seeking victory, and we saw battles that I have never witnessed before, and we brought the enemy to its knees.

While in your mother, the planes would burn the lands and whoever was on it in Chechnya, So praise Allah that you heard the sound of bullets and explosions whilst you were in your mother’s stomach, while your mother would escape from place to place. My precious, do not dream of living a luxurious, happy, peaceful life for the world of kufr will chase you, follow your father and choose a life of honour and dignity before you are thrown in the prisons of kufr, and your fathers friends and those with them were caught, and you are not far from nor better than your fathers friends. Make a serious decision in your life, and stick to it, and believe in Allahs victory and don’t listen to "this and that" and ask too much. So seek knowledge and memorise the book of Allah while you are young, then prepare and wage jihaad in the path of Allah.

My son I don’t know if we will be together in the battlefield, you my commander and me a soldier under you, watering the thirsty and nursing wounds, then you alone and me in the grave, this is a soldiers advice to his commander, be for me a continuous charity and a righteous son O Saleh, making supplications for me, for that is all that is left for a slave after his death, as the prophet peace be upon him said.

And I ask my lord to protect you to help this religion in every place and to provide you from his great bounties, and not allow the enemies of Allah to gain an upper hand over you and not let them give you while they humiliate you, and grant you martyrdom purely for the sake of Allah the generous, and to intercede for your poor father and mother, may Allah increase your honour and strength over the disbelievers, and Allahu akbar, your father, Khattab.

"Why Is My Dad in Guantanamo"


LONDON — "Why is my dad in prison? Why is he far away in that place called Guantanamo Bay," a ten-year-old boy asked in a poignant letter to British Prime Minister Tony Blair on Thursday, January 11.

"No one knows what the meaning of four years without a dad," said Anas who walked to Blair's Number 10 Downing Street with his nine-year-old brother Mohammed seeking information about their father, reported Agence France-Presse (AFP).

"No one knows how my life has changed after my dad was kidnapped from my life only because he didn't have British passport," wrote the ten-year-old child.

The father, Jamil, was arrested with a friend during a business trip to Gambia in 2002 on suspicion of links to terrorist groups.

They were handed over to US security officers and transferred to the notorious detention camp in Cuba.

The child's letter to Blair is part of worldwide protests to mark five years since Guantanamo was opened on January 11, 2002.

Washington has been holding hundreds of detainees at the notorious detention facility, mostly arrested in Afghanistan after the toppling of Taliban following the 9/11 attacks. Only ten of them have been indicted for charges.

Guantanamo's buildings hide behind multiple rows of 12-foot chain-link fences covered in green tarpaulins and topped with tight spirals of barbed wire.

Old wooden and newer steel watchtowers dot the perimeter.

Heartbreaking
Anas, in his fourth letter to Blair, one each year for the four his father has been held, asked the prime minister if he really cares for the fate of his father.

"Your children spend Christmas with you but me and my brothers and sisters have spent `Eid alone without our dad for three years," wrote the kid.

"What do you think about that? I hope you answer me this time."

Jamil, a Jordanian, and his friend, Bisher al-Rawi, an Iraqi, are not British citizens but have the right to reside in Britain.

He is one of eight British residents believed to be held at Guantanamo.

All British citizens were freed from the detention center by September 2004, but London insists it has no power to intervene on behalf of foreign nationals, even if they have long been resident in Britain.

"What are 350 people still doing there?" asked Asif Iqbal, a Briton of Pakistani descent who was released from the detention camp two years ago after being held for about three years.

"We believe they are innocent until proven guilty," said the 25-year-old man who used to consider the US "a beacon of hope" and now considers it "worse than any communist country."

Iqbal is one of hundreds of relatives and activists who traveled to Cuba with the hope of having a glimpse of their beloved held in the notorious camp.

"I'm very excited to be so close to my son," said a tearful Zohra Zewawi, standing by a monument to the revolution in the Cuban city of Guantanamo.

"My big wish is to release him, see him and hug him; and for all the others to be freed."

Day of Shame

Human rights groups said that the US practices at the Guantanamo Bay had weakened human rights and the rule of law around the world.

"January 11, 2007, is a national day of shame," Britain's Stop the War Coalition said in a statement.

"Guantanamo has come to symbolize the hollowness of the US government’s promise that respect for human dignity and the rule of law would lie at the heart of its response to the attacks of 11 September 2001," agreed Irene Khan, Secretary General of Amnesty International.

"Torture, humiliation, discrimination, bypassing of the courts and disregard for treaty obligations, with almost total impunity, are all now among the entries in the Guantanamo logbook."

The London-based human rights group, which has planned global vigils to mark the anniversary in many world countries, called for shutting down the notorious US detention camp.

"The US government must end this travesty of justice," said Khan.

"With every passing day, the cruelty of this indefinite detention regime ratchets up another notch."

Amnesty insists Guantanamo has become a "symbol of abuse and represents a system of detention that is betraying the best US values and undermines international standards."
The international rights watchdog once likened it to gulag prisons, the Soviet detention centers notorious for torturing political prisoners and suspects.

Which Jihad is Considered “True” in Saudi Arabia?

Hypocrisy of the governors of Saudi Arabia is well-known. In this brief material I wish to result only one comparison of a position of this country in days of Jihad in Afghanistan (the Soviet invasion) and today's Jihad in Iraq and in the same Afghanistan.


Russians have invaded per 1979 in Afghanistan, and have established board which submitted to them. And Saudi Arabia has not recognized this occupational government. Americans have grasped not only Afghanistan, but also Iraq, and in each of these two countries the government has obeyed to their will. Saudi Arabia has recognized both American occupational boards.


The Saudi government supported the Afghani Mujahideen morally to battle to the Soviet armies while today it perceives Mujahideen in Afghanistan and especially in Iraq as criminals, threatens those who tries to help them and declares any help to Mujahideen a crime.


The Saudi state has allowed sheikhs and scientists during the Soviet invasion to approve Jihad in Afghanistan, to publish fetwas in this occasion, and today all fetwas concerning Iraq and Afghanistan are considered as an offence. Worse that, they everywhere push forward so-called scientists who publish fetwas, forbidding Jihad in Afghanistan and in Iraq and forbidding in it to participate.


The Saudi state helped young men, which wished to take part in Jihad (against advice) in Afghanistan. It has given them the right to different discounts and the privileges reached 70 %, and now desire to go in Iraq or Afghanistan are declared criminal and young men arrest and throw in prisons.


The Saudi governors accepted in the past of leaders of Jihad of Afghanistan and allowed to organize it conferences on the ground, and now they have joined enemies of the Islam, and pursue leaders of Jihad in Iraq.


Thus, when Jihad in Afghanistan did not infringe on interests of America and weakened enemies of the USA, Saudi Arabia was the supporter of Jihad on a way of the Allah. Sheikhs had the right to give фетвы in their direct sense, and to give to mojaheds support as in material, and the spiritual plan, and all the young men, wishing to accept in participation in Jihad, had the right to privileges and referred to as mojaheds.


However since that moment, as Jihad has infringed on interests of America (in Afghanistan and Iraq) it became terrorism and extremism. Those who takes part in Jihad, search and kill, and those who helps by means of the fetwas or money, put in prisons. Sheikhs have no right to state the Islamic legal point of view in this occasion, opposite official scientists publish fetwas, forbidding participation in Jihad, and Jihad declare terrorism.


The same has occurred and in relation to Chechnya . America has approved capture of Chechnya by Russia, and Saudi Arabia has acted also though Chechnya was grasped with the same Russian which grasped also Afghanistan.


Thus, clearly, that governors of Saudi Arabia do not recognize Jihad on the way of Allah. For them jihad on the way of America is lawful.


Everything, that kafirs allow, they (governors of Saudi Arabia) resolve and support, and everything, that they forbids, becomes forbidden.

On the occasion of Eid Al-Adha, 1427, we would like to take a moment to send our sincere greetings to you and your family on this blessed occasion and to share the good news of the Islamic awakening that is upon us.

As the end of the year approaches, we would also like to take this opportunity to congratulate the Muslims on the progress we have made during this past year. Many more of you now see that the Ummah is a nation at war against an aggressive American foreign policy that will not stop until our lands are decimated, our resources are pilfered and our religion has been subdued. Many more of you now see that the events of 911 were not the beginning of this war but were a response to a decade of abuse beginning with the occupation of the land of the two holy mosques, the brutal embargo that killed over 1 million of our children in Iraq, and the indiscriminate bombings of Sudan, Afghanistan and Iraq and the continuing ethnic cleansing of Palestinians that has gone on for half a decade.

It is no longer hidden from any of us, Muslim and non-Muslim alike, that America’s agenda has nothing to do with “terrorists” and has everything to do with controlling Muslim land, resources and minds. Five years on in this so-called war on terror the Mujahideen have proven once again that Allah is capable of all things.

In Afghanistan, Commander of the Faithful Mullah Omar has waged an unprecendeted defense after US forces claimed to be “moping up” in 2002. The Islamic Emirate of Afghanistan has been formed, Shariah law has been implemented in the that lands it controls and Afghans are flocking to support the Mujahideen.

Moreover, in Iraq, three years on in the illegal occupation of the country, our second Islamic Emirate has been formed, the new Islamic State of Iraq, and our Mujahideen have put up an impressive and relentless resistance against the worlds largest superpower proving that all the military hardware in the world can not defeat the hand made weapons of the Mujahideen if Allah wills it. The Islamic awakening is indeed occurring among the youth and the sincere ones and Allah has honored their efforts. The US is now entrenched in a war it can not win and both Muslims and non-Muslims are awakening to the real agenda behind this current assault on Islam.

While the media battle remains front and center in this conflict, like all the others, it is also a difficult battle. With mainstream news reporting having digressed to merely party-line propaganda, now more than the Muslim voices must speak.
